Terms of Service

These Terms of Service ("Terms") govern the custom strategy services offered through thesystematicone.com (the "Site"). The Systematic One is a service of Pura Vida Connections LLC, a New Mexico limited liability company ("The Systematic One", "we", "us", "our"). By submitting a brief, accepting a quote or making a payment, you ("you", "the client") agree to these Terms.

1. Definitions

Brief means the description of your strategy idea collected through the assistant on the Site or by email.

Quote means the written offer we send you by email after reviewing your brief, stating the package, any add-ons, the price and the payment schedule.

Package means one of the services described in Section 3.1.

Rule sheet means the written specification of your strategy's rules prepared during the engagement.

Strategy code means the Pine Script source code of the strategy built for you, including its alerts.

Validation report means the written report of the testing described in Section 3.1.

Modeled results means hypothetical results produced by testing a strategy on historical data. Modeled results are not results of actual trading.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher), have the legal capacity to enter into this agreement, and not be resident in a jurisdiction subject to U.S. OFAC sanctions or restricted by U.S. export control law.

3. The service

3.1 Packages

All prices are in U.S. dollars.

Validation, $497. Rule sheet; modeled testing with trading costs; account fit check; walk forward analysis; Monte Carlo simulation; sensitivity analysis; validation report. No production code is delivered under this package.

Strategy build, $1,497. Everything in Validation, plus: the strategy written in Pine Script v6 with alerts; delivery of the strategy code; one round of changes to the rules; an anonymous entry in our public build log (Section 7.2).

Build and deploy, $2,497. Everything in Strategy build, plus: alert setup and an execution bridge (TradersPost, PickMyTrade or PineConnector); connection of your broker or prop firm account; observation of the first live trade together with you; 30 days of email support after go-live, with replies within 24 hours.

3.2 Add-ons

Second instrument: $497. Second account preset: $297. Monthly live vs modeled review: $147 per month.

3.3 Platform

The service is delivered only for TradingView, in Pine Script.

3.4 Stages and timing

Indicative timing, in business days, each counted from your approval of the previous stage: rule sheet 2; build 3; testing 3; deployment 2, followed by observation of the first live trade. A typical engagement takes about 10 business days, not counting the time you take to review and approve each stage. Timing is an estimate, not a binding deadline.

3.5 What the service does not do

  • We do not trade on your account, and we do not store your logins, passwords or API keys.
  • We do not deploy a strategy that has not passed testing.
  • We do not promise that you will pass a prop firm evaluation, receive payouts, make a profit, or repeat modeled results. Modeled results and live results are reported separately.
  • The service is not investment, financial or trading advice, and it is not portfolio or asset management. All trading decisions, and the risk of every trade, are yours.
  • We are not responsible for the operation or rules of TradingView, execution bridges, brokers or prop firms. It is your responsibility to check that your prop firm permits automated trading.
  • We are not affiliated with or partnered with any prop firm. Prop firms named on the Site are independent companies.

4. Ordering

4.1 You submit a brief through the assistant on the Site, by text or voice.

4.2 An analyst reviews your brief and sends you a quote by email, normally within 24 business hours. Price ranges given by the assistant are indicative only and are not an offer. The final price is set by the analyst in the quote.

4.3 The contract between you and us is formed when you accept the quote and make the first payment under Section 5. The price in the quote is binding from that moment.

5. Payment

5.1 Payments are made through a Dodo Payments link included in the quote. Dodo Payments acts as Merchant of Record and handles billing and tax. Invoices are issued by Pura Vida Connections LLC.

5.2 Each package is paid in two parts: 50% when you accept the quote (the "deposit") and 50% on delivery (the "final payment"). The final payment is due:

  • Validation: on delivery of the validation report;
  • Strategy build: on delivery of the strategy code;
  • Build and deploy: after the first live trade, and in any case no later than 5 business days after deployment is completed, whether or not a trade has taken place. If you have not connected your account within 10 business days after delivery of the strategy code, deployment is treated as completed on that day.

5.3 We do not hand over the strategy code before payment in full.

6. Cancellation and refunds

6.1 Deposit. The deposit is non-refundable from the moment it is paid. It reserves analyst time and starts work on your engagement.

6.2 Cancellation during the build. If you cancel during the build, the final payment is not charged. The deposit is not refunded.

6.3 Strategy does not pass testing. A strategy that does not pass testing is not deployed. The service is the build and the testing, not a particular result, so the outcome of testing does not affect payment except as stated here:

  • Validation: you receive the validation report and the final payment is due on its delivery.
  • Strategy build: one round of changes to the rules is included in the price. If the strategy still does not pass after that round, you receive the validation report and the strategy code, and the final payment is due on their delivery.
  • Build and deploy: the deployment stage is not performed and not charged. The total price becomes $1,497 (the Strategy build price). The deposit already paid is credited, and the balance is due on delivery of the validation report and the strategy code.

6.4 Strategy passes testing but you reject it. No refund is due. One round of changes to the rules is included in the price.

6.5 Consumers in the EEA and the UK. If you are a consumer in the European Economic Area or the United Kingdom, you have a legal right to withdraw from a services contract within 14 days. When you accept a quote and pay the deposit, you expressly request that we start work immediately, and you acknowledge that you lose your right of withdrawal once the service has been fully performed. If you withdraw before then, you pay for the work performed up to the moment of withdrawal, which the deposit covers.

6.6 No money-back period. The service is custom work. The 14-day money-back policy of Puravida Edge does not apply.

7. Ownership and confidentiality

7.1 What you own. After payment in full, the rule sheet and the strategy code built for you, including the full source code, are your property.

7.2 What we keep. We keep the right to publish one anonymous entry about your engagement in our public build log, limited to: market, type of rules, build time, and modeled vs live results after 30 and 90 days. The entry never includes your name or your rules. We also keep the right to use our general methods, but not your rules, in later builds.

7.3 Your rules. We do not publish or resell your rules.

8. Risk disclosure

Trading futures and CFDs involves a high risk of loss and is not suitable for everyone. Modeled results are hypothetical. They are prepared with the benefit of hindsight, do not reflect actual trading, and may not account for factors such as liquidity, slippage and execution delays. No representation is made that any account will achieve results similar to modeled results. Past performance, modeled or live, does not indicate future results.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTY THAT A STRATEGY WILL BE PROFITABLE, WILL PASS A PROP FIRM EVALUATION, OR WILL PERFORM IN LIVE TRADING AS IT DID IN TESTING.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY TRADING LOSSES, PROP FIRM FEES, RESET COSTS OR LOST PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE ENGAGEMENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Pura Vida Connections LLC from claims, losses and expenses arising from your breach of these Terms, your violation of any law or third-party rules (including prop firm rules), or your trading activity.

12. Dispute resolution

12.1 Before starting any formal dispute, you agree to contact us at hello@thesystematicone.com and try to resolve it informally within 30 days.

12.2 If informal resolution fails, any dispute arising out of these Terms or the service will be resolved by binding arbitration administered by the American Arbitration Association under its commercial rules, conducted in English, with venue in Albuquerque, New Mexico. Claims for injunctive relief to protect intellectual property and small claims matters are excluded.

12.3 You waive the right to a jury trial and to take part in any class action, class arbitration or representative proceeding.

13. Governing law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict of laws principles. The UN Convention on Contracts for the International Sale of Goods does not apply. Nothing in these Terms limits mandatory consumer rights you have under the law of your country of residence.

14. Changes to these terms

We may update these Terms. An engagement already under way remains governed by the Terms in force when you accepted its quote.

15. General

These Terms, the accepted quote and our Privacy Policy are the entire agreement between you and us about the service. If any provision is unenforceable, the rest remains in effect. Neither party is liable for delays caused by events beyond its reasonable control, including outages of TradingView, execution bridges, brokers or prop firms.
